Observation details

I believe the photos show a Horned Grebe in non-breeding plumage. Merlin is indicating the bird in photo 4140(1) is a Black Scoter and not a Horned Grebe so I have included a cropped version of the same photo, 4140(2). Please advise as to the correct ID.
